{"id":61,"date":"2011-06-14T18:01:17","date_gmt":"2011-06-14T18:01:17","guid":{"rendered":"https:\/\/indianaviationnews.net\/decisionheight\/?p=61"},"modified":"2011-06-14T18:17:44","modified_gmt":"2011-06-14T18:17:44","slug":"reopen-mangalore-crash-investigation","status":"publish","type":"post","link":"https:\/\/indianaviationnews.net\/decisionheight\/2011\/06\/14\/reopen-mangalore-crash-investigation\/","title":{"rendered":"Reopen Mangalore Crash Investigation"},"content":{"rendered":"<p><strong>By Jacob K Philip<\/strong><br \/>\n<span style=\"text-decoration: underline;\">Editor, <a href=\"https:\/\/indianaviationnews.net\">Aviation India<\/a><\/span><\/p>\n<p><strong><span style=\"color: #ff0000;\">T<\/span><\/strong>he investigation of the 2011 May 22 crash of Air India Express Flight 812 must be reopened.<\/p>\n<p>The Indian Government should discard the the biased, incomplete and erroneous whitewash of a report submitted on April 26, 2011 by the Court of Inquiry and should immediately\u00a0order a reinvestigation.<\/p>\n<p>The demand for the urgent reopening of the inquiry of the tragic crash in which as many as 158 lives had perished is perfectly in accordance to the rule of the land.<\/p>\n<p>On 2009 March 13, the Government of India had inserted vide GSR No. 168(E) \u00a0a very important rule to &#8216;The Aircraft Rules 1937&#8217;, which govern everything aviation in this country.<br \/>\nHere is the rule:<\/p>\n<blockquote><p><a href=\"http:\/\/dgca.nic.in\/rules\/act-ind.htm\" target=\"_blank\">75A. Reopening of Investigation<\/a> \u2013 <strong>Where it appears to the Central Government that any new and material evidence has become available after completion of the investigation under rule 71, 74 or 75, as the case may be, it may, by order, direct the reopening of the same. <\/strong><\/p><\/blockquote>\n<p>The series of six articles published in <a href=\"http:\/\/avindia.blogspot.com\" target=\"_blank\">Aviation India<\/a> and <a href=\"https:\/\/indianaviationnews.net\/decisionheight\" target=\"_blank\">Decision Height<\/a> from \u00a0May 15 \u00a0to June 2011 make it abundantly clear that there are enough new and material evidence that make the reopening of the investigation absolutely necessary.<\/p>\n<p>Here is a list of those <em><strong>new and material<\/strong><\/em> evidence:<\/p>\n<ol>\n<li><span style=\"color: #000000;\">The fact that a huge portion of the wreckage was taken away from the crash site by locals and was sold as scrap metal. What the Court of Inquiry was inspected and studied (if at all they had done any study) was the remaing wreckage. (<\/span><a href=\"https:\/\/indianaviationnews.net\/decisionheight\/2011\/05\/16\/when-evidence-reached-scrap-metal-shops\/\" target=\"_blank\"><span style=\"color: #000000;\"> Read the article..<\/span><\/a><span style=\"color: #000000;\"><em>)<\/em><\/span><\/li>\n<li><span style=\"color: #000000;\">The reconstruction of the wreckage was never actually done by the CoI. The image of the reconstructed wreckage included in the report was a computer generated one. (<\/span><a href=\"https:\/\/indianaviationnews.net\/decisionheight\/2011\/05\/24\/mangalore-crash-an-inquiry-that-ends-with-photoshopping-the-truth\/\" target=\"_blank\"><span style=\"color: #000000;\">Read The Article..<\/span><\/a><span style=\"color: #000000;\">)<\/span><\/li>\n<li><span style=\"color: #000000;\">While testifying before the court of Inquiry at Mangalore airport, Six survivors of the crash were made to answer a totaly biased and misleading question by the CoI. The question was, &#8220;Do you think the accident occurred because of the fault of the pilot?&#8221;This was in plain violation of Rule 7.2.1 of the Manual of Accident\/ incident investigation: &#8216; The investigation of aircraft accidents and incidents has to be strictly objective and totally impartial and must also be perceived to be so&#8217;. <\/span><a href=\"https:\/\/indianaviationnews.net\/decisionheight\/2011\/05\/20\/a-case-that-was-settled-eight-months-before-the-verdict\/\" target=\"_blank\"><span style=\"color: #000000;\">(Read The Article..) <\/span><\/a><\/li>\n<li><span style=\"color: #000000;\">The \u201c Hard Landing\u201d circular issued by Air India is a major contributor to the accident.
